Terms & Conditions

Please note: This page is a general template intended to describe how Global Website Solutions operates. It is not a substitute for professional legal advice. Global Website Solutions is not currently a formally registered company or corporate entity; services are provided by an independent individual trading as "Global Website Solutions" (referred to below as "we," "us," or the "Provider") serving clients globally, with primary operations in the United States and Zimbabwe.

1. Acceptance of Terms

By engaging Global Website Solutions to design, develop, or maintain a website (the "Services"), you (the "Client") agree to these Terms & Conditions. If you do not agree, please do not proceed with a project or payment.

2. Services

We provide website design, development, and ongoing maintenance services, as described on our Pricing page or as otherwise agreed in writing (including by email) with the Client. The specific scope, deliverables, and timeline for each project will be confirmed with the Client before work begins.

3. Quotes, Pricing & Payment

  • Package prices listed on our website are starting prices and may vary based on project scope, complexity, or custom requirements confirmed with the Client in advance.
  • Unless otherwise agreed, a deposit is required before work begins, with the remaining balance due upon completion or according to a payment schedule agreed with the Client.
  • Monthly and yearly maintenance plans are billed in advance for the applicable period and renew automatically unless cancelled as described in Section 9.
  • Prices are subject to change for new projects; prices already agreed with a Client for an active project will not change without the Client's consent.

4. Revisions & Project Scope

Each package includes a set number of revision rounds, as described on the Pricing page. Requests that fall outside the agreed scope of a project (for example, additional pages, new features, or a change in design direction after work has begun) may be treated as additional work and quoted separately.

5. Client Responsibilities

To keep a project on schedule, the Client agrees to provide timely feedback, content (text, images, logos, and other materials), and access to any accounts needed (such as domain or hosting access) when reasonably requested. Delays in providing these may delay project delivery.

6. Intellectual Property

  • Upon full and final payment, ownership of the completed website design and custom code developed specifically for the Client transfers to the Client, except for any third-party assets, licensed software, stock images, fonts, or open-source components, which remain subject to their own licenses.
  • Until full payment is received, all work remains the property of the Provider.
  • Unless the Client requests otherwise in writing, we may display completed projects in our portfolio and reference the Client's business name for promotional purposes.

7. Third-Party Services

Websites we build may rely on third-party services such as domain registrars, hosting providers, or software platforms. These services have their own terms and fees, which are the Client's responsibility unless otherwise agreed. We are not responsible for outages, price changes, or policy changes made by third-party providers.

8. Website Maintenance Plans

  • Maintenance plans cover the items listed on our Pricing page (for example, software updates, backups, and minor content edits) and do not include large redesigns, new features, or work beyond the stated scope, which may be quoted separately.
  • Maintenance plans may be cancelled at any time; cancellation takes effect at the end of the current billing period, and amounts already paid for that period are non-refundable.

9. Warranties & Disclaimers

Websites are provided on an "as is" and "as available" basis. While we take reasonable care to deliver functional, well-tested work, we do not guarantee that a website will be uninterrupted, error-free, or achieve any particular business outcome (such as a specific level of traffic, leads, or sales).

10. Limitation of Liability

To the fullest extent permitted by law, Global Website Solutions will not be liable for any indirect, incidental, or consequential damages arising from the use of, or inability to use, a website we have built or maintained. Our total liability for any claim relating to the Services will not exceed the amount the Client paid for the specific project or plan giving rise to the claim.

11. Termination

Either party may end a project before completion by notifying the other in writing. In that case, the Client will be responsible for payment for work completed up to that point, and any deposit already paid is non-refundable unless we have failed to begin work as agreed.

12. Confidentiality

We will treat any non-public business information shared by the Client during a project as confidential and will not disclose it to third parties, except as necessary to deliver the Services or as required by law.

13. Governing Law & Disputes

Global Website Solutions serves clients globally, with primary operations in the United States and Zimbabwe. Unless a separate written agreement with a Client specifies otherwise, we will first attempt to resolve any dispute informally and in good faith. Where a dispute cannot be resolved informally, it will be governed by, and subject to the jurisdiction applicable to, the country in which the Provider is operating at the time the relevant project agreement was made.

14. Changes to These Terms

We may update these Terms & Conditions from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our Services after changes are posted constitutes acceptance of the updated Terms.
